Council of State Advisory Opinion RITE 094 : Interpretation of Articles 80(h) and 276 of the DRC Mining Code

RITE Opinion 094 of the DRC Council of State, issued on 14 July 2025, interprets Articles 80(h) and 276 of the Mining Code, as amended in 2018. Article 80(h) requires the transfer of 5% of shares to the State upon renewal of operating licences. To avoid excessive dilution of the capital of holders of multiple permits, the Opinion recommends a single transfer of 5% for all permits held.
