Decree No. 21/04 of October 2, 2021, establishing the organization and functioning of the Public-Private Partnership Advisory and Coordination Unit, abbreviated as "UC-PPP," provides for a portion of the fees paid by private partners in the context of the operation of public-private partnership projects as resources for this service.
The interministerial order No. 215/CAB/MINET/PLAN/JST/FAB/ie/2023 CAB/MIN.FINANCES/2023 of December 26, 2023, sets the collection methods and the allocation key for the portion of these fees.
This order applies to public-private partnership projects concluded at both the central and provincial levels, as well as at the level of decentralized territorial entities.
It establishes an allocation key for the fees among various state services involved, namely: the UC-PPP, the offices of the Minister of Planning and that of Finance, the Public Procurement Regulatory Authority (ARMP), and the Inspectorate General of Finance.
It also sets out the procedures for the collection of funds due under the portion of the fees paid by private partners.
The contribution of this ministerial order is to establish a clear and transparent framework for the collection and allocation of fees related to public-private partnership projects, thereby contributing to effective fund management and equitable resource allocation.
